The Firm assists businesses, professionals and individuals in managing financial distress and crisis situations, identifying the legal instruments available under the Italian Business Crisis and Insolvency Code that are best suited to the client’s circumstances.

Insolvency Proceedings

The Firm’s activities include assessing the financial crisis, evaluating the available legal instruments and providing assistance in proceedings governed by the Italian Business Crisis and Insolvency Code, including in dealings with the relevant bodies and before the competent courts.

The Firm assists, in particular, with judicial liquidation and other proceedings applicable to businesses facing financial distress or insolvency.

Over-indebtedness

For individuals and entities not subject to the main insolvency proceedings, including consumers, professionals, small businesses and agricultural enterprises, the Firm provides assistance in accessing the legal remedies available under the Italian over-indebtedness framework.

The Firm’s activities include, in particular:

• consumer debt restructuring;
• restructuring proceedings for professionals and small businesses;
• controlled liquidation of over-indebted debtors;
• discharge of debt for an insolvent debtor with no assets or income available for distribution.

Avv. Mariaclaudia Guidotti, of counsel, also acts as a Crisis Manager in over-indebtedness proceedings with the Crisis Settlement Body (OCC) of the Bologna Bar Association, carrying out activities within the scope of the proceedings handled by the Body.
